Court orders review of Sky Sports wholesale pricing decision

500px-Sky_Sports_logoSky could be forced to offer rival BT the right to sell Sky Sports 1 & 2 to BT TV customers following a Court of Appeal ruling.

Media regulator Ofcom had previously ruled the satellite giant must offer its most popular sport channels to rivals at a discount under a “wholesale must offer” to ensure customers had a choice of pay-TV provider without missing out on top sporting events.

That ruling was struck down in 2012 by the Competition Appeals Tribunal (CAT) following an appeal by Sky.

Sky says deals with Virgin Media, TalkTalk and the now defunct TopUpTV to offer the channels prove it’s willing to strike commercially viable agreements with rivals.

Although BT is able to offer Sky Sports 1 & 2 to users of its now withdrawn Vision+ boxes, the two firms have failed to agree a deal for them to be offered to subscribers with the newer YouView box.

Sky has previously suggested it’s open to wholesaling its channels to BT if it in turn allows Sky to sell BT Sport direct to its customers. At present Sky viewers must subscribe to the channels by contacting BT.

However on Monday Lord Justice Aikens said the CAT had failed to properly consider statements made to it by Ofcom and that as a result there had been “errors of law” in its handling of Sky’s appeal.

Today’s ruling doesn’t secure access to the channels for BT and its customers but does mean the CAT will have to reconsider its ruling.

In a statement Ofcom said: “Ofcom welcomes the Court of Appeal’s decision that the judgment of the Competition Appeal Tribunal failed properly to consider Ofcom’s findings that there was ineffective competition in the market.

“Ensuring fair and effective competition in the pay TV market has always been Ofcom’s objective. Ofcom’s 2010 decision that Sky must offer premium sports channels to other providers was designed to deliver choice and innovation to consumers through greater competition.”

A BT spokesperson said: “We are glad that this issue will now be considered afresh and are hopeful that the outcome will finally deliver increased competition in pay-TV which would be in the best interests of consumers.”

Sky said today’s ruling “does not alter in any way the CAT’s fundamental findings, overturning Ofcom, that Sky engaged constructively with other distributors over the supply of its premium sports channels, and that Virgin Media is able to compete effectively with Sky on the basis of Sky’s rate card prices.”

BT Sport announces MotoGP programming and presenters

BT_Sport_MotoGPBT Sport has unveiled details of its MotoGP programming plus presenters and commentary team ahead of next month’s start to the 2014 season.

The channel has exclusive rights to the sport for the next five years and is promising “comprehensive coverage” both on TV and via its app which will host exclusive ‘second screen’ content.

Coverage starts on March 18 with a special preview show which will include interviews with all the top riders and action from the key official pre-season tests. 

In addition to live broadcasts of practice and qualifying sessions and races from the FIM MotoGP season, BT says it will bring fans “full coverage” of the Moto2 and Moto3 races. 

There will also be a new hour-long programme, MotoGP Tonight, broadcast after every Grand Prix weekend.

BT Broadband, BT TV customers and Sky customers who get the BT Sport channels direct from the ISP will be able to use its app to choose between seven camera views, including four cameras fitted to bikes, a helicopter view and live timing and tracking screens.

Full races and highlights including interviews and features will also be available to watch.

The app is only available to customers who get the channels from BT, meaning Plusnet and Virgin Media customers will be unable to access the extra camera views.

BT says live race coverage will usually start on Friday mornings, providing fans with around five hours of coverage each day, although the night-time event in Qatar will be an exception to this with additional coverage on Thursday March 20.

In addition to programming details, BT Sport has announced the presenters and commentators who will front its coverage.

Model and TV presenter Melanie Sykes will oversee race weekends alongside MotoGP experts, former British and World Superbike Champions, Neil Hodgson and James Toseland.

The channel has also hired former Eurosport MotoGP commentator Julian Ryder who be joined by British Champion Keith Huewen and Motorcycle News chief grand prix correspondent, Matt Birt.

Craig Doyle and former Olympian and European and Commonwealth games 400 metres champion and biker, Iwan Thomas will present MotoGP Tonight and Gavin Emmett has been hired as MotoGP reporter.

BT says coverage will be based on-site at each event with additional studio coverage coming from its studio at the Olympic Park in Stratford, East London.

Simon Green, head of BT Sport, said: “It’s really exciting to be launching such a thrilling new sport on BT Sport, with a tremendous new team and what we believe will be a fresh approach to MotoGP and some fantastic new shows.
    
“MotoGP is the top, two-wheeled motorsport. It’s massive in the UK and we’re heading into it at full throttle and following every second of the action. We’re sure we’ll appeal to committed fans, but we also think we will win over and welcome new fans to the sport.”

Manel Arroyo, managing director, Dorna Sports, said: “I’m pleased that MotoGP is part of such a huge and exciting project as BT Sport. I’m sure that BT Sport will provide the in-depth coverage that MotoGP deserves so that British fans can follow the fortunes of British riders in the Championship.”

BT Sport helps drives up ISP’s revenues and profits

BT says its investment in sport has helped it deliver an 8% increase in pre-tax profits and a 6% increase in revenues from its consumer division for the third quarter of the financial year.

The company says revenue was “driven by 22% growth in broadband and TV revenue, reflecting the benefit of BT Sport to our top line.”

The BT Sport channels now have 2.5m direct customers in addition to BT’s wholesale agreement with Virgin Media.

IN addition to revenue growth, the sport channels are being credited both with a 60% decrease in the number of consumer line losses and the addition of 150,000 new broadband customers.

Including upgrades and migrations, BT also saw an additional 228,000 connections to its Fibre broadband service and added 53,000 new TV customers – “more than double the prior year” – and taking total numbers to 956,000.

Gavin Patterson, Chief Executive, said: “Our strategic investments are delivering. It was another record quarter for fibre take-up and there are now more than 18 million premises with access to our fibre. That number will grow further as the BDUK programme progresses.

“Fibre helps SMEs to compete and underpins our TV plans. Our direct BT Sport customer base passed 2.5 million in the quarter and helped to support 6% revenue growth in our Consumer business.

“We achieved some particularly strong audience figures in December and the exclusive rights to the UEFA Champions League and UEFA Europa League that we have won will further strengthen the appeal of our proposition.”
